2019 Arrest of Dyma Loving

On March 5, 2019, Giraldo and Officer J.F. Calderon responded to a report that a neighbor had pointed a shotgun at Loving and Adriana Green.[4][5]

During the investigation, Loving became agitated, and Giraldo threatened to arrest her for disorderly conduct and have her involuntarily committed to a mental institution. Giraldo took Loving to the ground and arrested her.[5]

Video shows Giraldo and Green discussing the arrest. When Green suggested that Giraldo could have acted "in a different way", Giraldo says, "Yeah, I could have Tased her".[5]

Loving was arrested for disorderly conduct and resisting arrest.[5] The charges were later dropped.[1]

The incident was captured by officers' body-worn cameras and Green's cellphone camera.[5]

Giraldo was suspended with pay.[1][6]

On April 10, 2019, Loving filed a lawsuit against the department, the county, Giraldo, and Calderon.[6] Loving claims false arrest, false imprisonment, use of excessive force, malicious prosecution, infliction of emotional distress, and civil conspiracy against the officers, and several claims against the department and county.[7]

On May 3, 2019, Giraldo was arrested after investigators determined that video and reports from the other officers did not support Giraldo's claim that Loving was being disorderly.[1] Giraldo was charged with felony official misconduct and misdemeanor battery.[8]

By June 2020, Giraldo had been fired.[3]

On April 14, 2022, Giraldo was convicted of battery and official misconduct.[4]

On June 23, 2022, Giraldo was sentenced to 364 days in jail.[9]
