2020 Driving While Impaired
On May 9, 2020, Capshaw was off-duty and driving in his personal vehicle when he sideswiped another vehicle. 
Capshaw resigned from the Angier Police Department following his arrest.
In May 2020, Capshaw was charged with driving while impaired.
The courts found Capshaw not guilty.
2021 Traffic Accident
On October 20, 2021, Capshaw was off-duty when he ran a stop sign while driving his town-issued 2016 Dodge Charger police car and collided with another vehicle. Capshaw claimed to have swerved to avoid hitting a dog, causing him to not see the stop sign.
Capshaw was suspended for a week without pay.
On October 20, 2021, the North Carolina State Highway Patrol said charges were pending.
Capshaw was charged with failure to stop and yield right of way.
