On August 9, 2021, Tustin California Police Department Officer Estella Silva and two others responded to a call of a man with a knife. Officers encountered Garcia, who was homeless and sleeping in some bushes. Officers ordered Garcia to come out of the bushes. Garcia was carrying a bag and a stick, which prompted one officer to draw their taser and Silva to draw her firearm. Both fired, striking Garcia, who died at a local hospital.[1]

The shooting is being investigated by the Orange County District Attorney's Office and the state Department of Justice, which reviews all officer-involved shootings when the victim was unarmed.[2][3]

On January 20, 2022, Garcia's family filed a lawsuit against the city of Los Angeles and the officers involved, alleging the use of excessive force and delinquency during the arrest.[1]


The incident was captured on one officer's body-worn camera.[2]
