Overview

On March 12, 2021, Austin Texas Police Department Officers Katherine Alzola, James DeStaso, Eric Perez, and an unidentified 4th officer responded to an "Unknown - Urgent" call. During the investigation, they recognized "Mr. CJ", who had a warrant for assault in a family violence case. According to police, Mr. CJ resisted arrest and officers attempted to use force to affect the arrest. During the struggle, Mr. CJ "inadvertently handcuffed himself", at which point Perez secured the handcuffs but didn't inform the other officers. The 4th officer deployed his Taser three times while Mr. CJ was handcuffed.[1]

After the arrest, Alzola asked Perez to turn off his body worn camera, and the two had an unrecorded conversation about the incident.[1]

Alzona gave an incomplete statement to an on-scene supervisor, and filed an incomplete written incident report.[1]

On September 27, 2021, Perez was suspended for 90 days for failing to intercede in a use of force incident, not properly reporting the use of force incident, and improperly deactivating his body worn camera[2]

On September 29, 2021, Alzola was suspended for 90 days for failing to intercede in a use of force incident, not properly reporting the use of force incident, and improperly deactivating her body worn camera[3][4]
