Jimmy Brooks (2015)
Overview
On August 30, 2015, Brooks' mother called the Vallejo California Police Department and requested a welfare check on her son, who had expressed suicidal thoughts. Officers found Brooks pouring gasoline on his porch, ordered him to wash it off, and left. Later that evening, Brooks' mother called police after hearing a gun shot from the neighboring house occupied by Brooks. Officers arrived, and Brooks hid under a porch for two hours. When he emerged, Brooks claimed he was beaten with batons by several officers before being arrested.[1]
Brooks suffered a broken ankle and fibula, and required stitches for multiple lacerations.[1]
On October 4, 2016, Brooks filed an lawsuit against the city and several then-unnamed officers, claiming violations of his rights under the Fourth and Fourteenth Amendments.[1]
By January 12, 2018, the lawsuit had been updated to name the chief, Zach Jacobsen, Ted Postolaki, Matt Samida, James Duncan, Jesse Hicks, and Spencer Muniz-Bottomley.[2]
On August 24, 2018, Muniz-Bottomley, Postolako, and Hicks were removed as defendants in the case.[3]
On November 27, 2018, the city settled the lawsuit for $50,000 and the case was dismissed.[4]
