On March 14, 2024, officers pulled over Smith's vehicle for speeding and failing to stop at red lights. Officers found that Smith had bloodshot and watery eyes, her breath smelled of alcohol, and she slurred her speech.[2]

The arrest was captured on officers' body-worn cameras.

Smith refused to submit to a field sobriety test or Breathalyzer test.[2]
