On August 16, 2023, a federal grand jury claimed that the officers "conspired and agreed together and with each other... to injure, oppress, threaten, and intimidate residents of Antioch" and indicted the officers for Conspiracy Against Rights and Deprivation of Rights Under Color of Law.[5]
On August 25, 2023, the state Commission on Peace Officer Standards and Training (POST) temporarily suspended Wenger's certification, citing Criminal Proceedings Pending - Egregious or Repeated Acts that Violate the Law.[6]
On May 8, 2024, Wilson and Smith filed a civil lawsuit against Wenger, Rombough, Amiri, and the city for violating their rights under the Fourth and Fourteenth Amendments of the U.S. Constitution.[7]
2019-2022 Drug Sales
From November 2019 to March 2022, Wenger and Officer Daniel Harris sold anabolic steroids.[8]
In March 2022, the officers sent text messages to each other about a plan to deliver anabolic steroids to another person.[8]
On March 23, 2022, the FBI executed a search warrant on Wenger's house and seized his cell phone. Wenger had deleted his text messages with Harris and the other person.[8]
Response Timeline
On August 16, 2023, a federal grand jury indicted Wenger for Conspiracy to Distribute and Possess with Intent to Distribute Anabolic Steroids and Destruction, Alteration, and Falsification of Records in Federal Investigations. The indictment requires the officers to forfeit any gains received if convicted on any charges.[8] Wenger faces up to 30 years in prison, plus fines.[9]
