On March 5, 2024, Montalvo was on-duty when he drove his vehicle into another police vehicle. Montalvo was "unsteady" when he exited his vehicle and was seen drawing his firearm and taking a "tactical-type position with... a dazed or confused look on his face". The other officer drew his firearm and ordered Montalvo to drop his, which he did. Montalvo told officers that he "drank too much" and was reported to have watery eyes and slurred speech.^[1]

Montalvo refused to perform a field sobriety test.^[1]
