Incident Reports
2020 Arrest of Elijah Tufono
On April 27, 2020, Fowell was on assignment with the City of Rancho Cordova when he saw the 14 year-old Tufono conduct a hand-to-hand sale of tobacco. Tufono refused to identify himself, despite "reasonable suspicion that criminal activity was occurring". Fowell attempted to detain Tufono, who resisted. Fowell struck Tufono in the abdomen twice, grabbed his wrist, and jerked his face to the ground.[1][3]
Part of the incident was captured on a witness' cell phone.[1]
Tufano was charged with resisting arrest.[4]
Response Timeline
An internal professional standards unit investigated, and concluded that Fowell had used excessive force.[1]
In 2020, Fowell was fired after the investigation was completed.[1]
On May 4, 2020, Tufono's family filed a claim against the county, which is a precursor to a lawsuit.[1][5]
In October 2020, Fowell appealed his termination.[1]
On December 15, 2020, Tufono and his family filed a lawsuit against the city and the officer, alleging violations of the Fourth and Fourteenth Amendments for the use of excessive force and denial of due process.[6]
In 2021, the county paid "six figures" to settle the family's civil lawsuit.[7]
On March 28, 2022, an arbitrator ruled that Fowell should be reinstated as his behavior did not warrant being terminated.[1]
