Hutchinson was reinstated with the Metro Transit Police due to a state law that puts elected officials back in their prior public position and adjusts their salaries as if they had never left.[3]

Incident Reports

2021 DWI

On December 8, 2021, Hutchinson was involved in an single-vehicle crash, in which he rolled a county-owned vehicle.[6]

Hutchinson told deputies and witnesses that someone else had been driving the vehicle.[7]

An investigation determined that Hutchinson was driving at 125 mph and was not wearing a seat belt.[8]

A urine sample showed Hutchinson's blood alcohol content at 0.13, nearly twice the legal limit.[6]

Response Timeline

Hutchinson was charged with fourth-degree driving while impaired, operating a motor vehicle under the influence of alcohol, operating a motor vehicle with a blood alcohol content of .08 within two hours, and carrying a pistol under the influence of alcohol, all misdemeanors.[6] The standard sentence calls for 90 days in jail, up to two years probation, a $500 fine, and a chemical-use assessment.[9]

On December 16, 2021, Hutchinson pleaded guilty to misdemeanor DWI. The other two DWI charges were dismissed as Minnesota law only allows conviction for one DWI offense per incident.[10][11]

On December 16, 2021, Hutchinson said that he had entered an alcohol treatment program and planned to remain as sheriff.[10]

On December 20, 2021, Hutchinson was sentenced to two years' probation, a fine, and other restrictions.[11]

In May 2022, Hutchinson went on medical leave.[8]

On September 22, 2022, the state Peace Officer Standards and Training (POST) Board suspended Hutchinson's license for 180 days, with all but 30 days suspended as long as Hutchinson has no new offenses for three years. The suspension was scheduled to start on November 22nd.[8][12]

On November 1, 2022, the County Board of Commissioners voted to not pay Hutchinson during his suspension.[8]

On March 17, 2023, Hutchinson was fired by the Minneapolis Metro Transit Minnesota Police Department for his 2021 actions, which "demonstrated poor judgment and reflected poorly on all of us in the department".[5]

2022 Workplace Misconduct

On April 19, 2022, Hutchinson threatened to retaliate against staff members who reported concerns about improper time keeping.[13]

Response Timeline

An outside firm was hired to investigate the behavior.[13]

An investigation found that Hutchinson showed a "pattern of harassment and workplace bullying" and had threatened some employees. The investigation revealed multiple incidents between 2019 and 2021, including racist and sexist statements.[13]

On December 8, 2022, a committee of the Hennepin County Board voted to recommend the censure of Hutchinson based on his workplace discrimination and bullying.[14]
