Incident Reports

2007 Complaint

On June 21, 2007, complaints were alleged against Marcial, including physical force, and use of a nightstick as a club. The complainant did not cooperate further with the Civilian Complaint Review Board (CCRB) investigation.[1]

2012-2013 Policy Violations

On May 26, 2012, Marcial was assigned to guard a hospitalized prisoner. It was reported that Marcial's eyes were closed and his hand was resting on his chin for approximately one minute.[2]

Between September 18, 2012 and January 10, 2013, Marcial failed to maintain a current New York State Driver's license.[2]

On January 11, 2013, Marcial improperly registered his car with New Jersey license plates.[2]

Between January 11, 2013 and January 30, 2013, Marcial operated his vehicle with an improper registration.[2]

On January 28, 2013, Marcial failed to safeguard a department-issued "tint meter".[2]

Between January 31, 2013 and February 12, 2013, Marcial operated his vehicle with expired registration.[2]

Response Timeline

Marcial pleaded guilty to all of the charges.[4]

On March 11, 2015, a trial was held for the 2012 and 2013 policy violations. Since Marcial pleaded guilty, he was dismissed from the department. The dismissal was suspended for one year, during which he was placed on probation. Marcial forfeited 30 days of vacation time.[4]

2014 Reassignment

On June 7, 2014, Marcial was transferred to a new precinct due to his "dismissive attitude and his inability to adhere to Department procedures".[2]

2017 Complaint

On July 16, 2017, seven complaints were alleged against Marcial, including physical force, entering premises, and offensive language. The CCRB exonerated Marcial on one charge and found the others to be unsubstantiated.[1]

2022 Off-Duty Shooting

On April 21, 2022, Marcial was off-duty and driving his vehicle when he shot at the husband of his girlfriend.[3]

The incident was captured by a surveillance camera.[5]

Response Timeline

The department launched investigations in the Internal Affairs and Force Investigation Divisions.[3]

On April 22, 2022, Marcial was suspended.[6]
