Overview

On October 25, 2023, Fort Smith Arkansas Police Department officers Tucker Romesburg, Caleb Jenkins, and Arthur Lewis were attempting to serve a felony warrant on Fairburn. Fairburn threatened to kill the officers, drew a knife, and moved towards the officers. Fairburn ignored the officers' commands to drop the knife. Fairburn fled, and Lewis' attempt to use a stun gun was ineffective. Fairburn threw a knife at Lewis, striking him in the leg. Romesburg and Jenkins saw another knife in Fairburn's other hand and fired, striking Fairburn.[1]

Officers rendered aid until paramedics arrived. Fairburn was taken to a hospital.[2]

The incident was captured on the officers' body-worn cameras and a witness's camera.[2]

On October 25, 2023, the officers were placed on paid administrative leave.[1]

The Arkansas State Police and the department opened investigations.[1]

On November 8, 2023, the county prosecutor announced that the shooting was justified under state law and that Romesburg and Jenkins would not be charged.[2]
