2022 Off-Duty Shooting

On November 20, 2022, Caselnova was off-duty at a bar in New York and got into an altercation with a group of other people. Caselnova and another person exchanged gunfire.^[2]

Police responded and shot Caselnova when he refused to drop his weapon.^[2]

The incident was captured by a surveillance system and responding officers' body-worn cameras.

Caselnova was placed on unpaid administrative leave.^[1]

On March 28, 2023, Caselnova was charged with second degree attempted murder, first degree assault, second degree menacing, second degree reckless endangerment, possession of a firearm in a sensitive location, two counts of possession of a large capacity ammunition feeding device, and second degree harassment.^[3]

Caselnova pleaded not guilty.^[4]

On May 2, 2023, a grand jury indicted Caselnova on attempted murder, includes assault, reckless endangerment, menacing, harassment, and possessing a firearm in a "sensitive location".^[5]

Caselnova Blood Alcohol Content (BAC) was found to be .132%, above the legal limit of .08%.^[6]

On September 20, 2023, a judge dismissed the charges, agreeing with Caselnova's lawyers that the prosecutor did not properly instruct the grand jury. The prosecutor could submit the charges to a new grand jury.^[6]
