2021 Death of Mauricio Luna

On August 13, 2021, Klingmann and officers Jasmine Reed and Adam Rosenbaum were responding to a burglary, reaching speeds of 90 mph and not using their lights and sirens. Klingmann struck a vehicle driven by Luna, killing him.[3][4]

It is against the law and department policy for officers to not use their lights and sirens.[4]

Response Timeline

Klingmann was placed on non-patrol duty pending an internal investigation.[3]

The District Attorney declined to charge Klingmann, claiming that his actions "did not create a risk of such nature and degree that injury or death was likely and foreseeable" and that Luna's "failure to yield" contributed to his death.[4]

On March 25, 2022, Luna's family filed a wrongful death lawsuit.[4]

On June 7, 2022, Klingmann resigned.[1]

On October 11, 2022, the lawsuit was settled for $300,000.[3]
