In March 2022, Hardaway was placed on administrative duty.[2]
On June 6, 2022, a grand jury indicted Hardaway for manslaughter. The case goes to a state attorney for prosecution. If convicted of manslaughter - a second-degree felony - Hardaway could be sentenced to up to 15 years in prison.[3]
Hardaway was suspended during the criminal proceedings.[2]
On August 27, 2025, the State Attorney dropped the charges against Hardaway.[4]
On August 27, 2025, the agency announced that Hardaway would return to work on September 2.[4]
