2026 Excessive Force

On January 30, 2026, officers responded to a vehicle with no license plates and front-end damage. The vehicle fled before crashing. Two occupants of the vehicle ran from the scene. Officers tracked one of the men, who surrendered and followed officers' commands.[3]

As the officers handcuffed the man, Best arrived and "dropped down on top of" the man's neck and shoulder blade area. As the man was being led away, he asked Best if he "[took] pride in [the contact]", to which Best replied "Sure do".[3]

Other officers described the contact as an "unnecessary drop knee kick" and that the man was not resisting.[3]

The incident was captured on body-worn camera.[3]

Response Timeline

An internal investigation determined the use of force was inconsistent with state guidelines or department policies and the case was referred to the Waukesha County District Attorney's Office.[2]

The agency asked the Brookfield Wisconsin Police Department to conduct an independent investigation.[2]

Best was placed on administrative duty.[2]

Best was charged with felony misconduct in public office - acting in excess of lawful authority. Best faces a maximum of 3.5 years in prison.[2]
