2023 Assault of Ryan York

On July 15, 2023, police responded to a domestic incident and took a woman into custody. York, her husband, tried to pull officers away from her. York was also taken into custody and placed in the back seat of a police vehicle. While York was leaning out of the open vehicle door in medical distress, Kelly approached and kicked York in the head. When York asked for an explanation, Kelly said, "because you hit my officer".[2][1]

The incident was captured on body-worn cameras.

Response Timeline

Kelly was placed on administrative leave.[2]

On July 27, 2023, Kelly was charged with misdemeanor assault.[2]

On December 28, 2023, Kelly sued the agency under the Police Officer Bill of Rights.[3]

On February 14, 2024, Kelly was found guilty in District Court of assault, and sentenced to a year of probation. Kelly appealed to Superior Court.[4]

On April 2, 2024, the Superior Court case was closed following a pre-trial conference.[5]
