Ki'Anthony Tyus (2018)
Overview
On December 22, 2018, Louisville Kentucky Metro Police Department officers identified a stolen vehicle and began a chase. After the first two officers crashed, Officer Roger Marcum and an officer in another cruiser picked up the pursuit.[1]
Department policy at the time forbade officers from chasing cars unless a violent felony had been committed or a suspect was wanted for a violent crime. [1]
Marcum used his vehicle to cause the stolen vehicle to crash, killing Tyus and injuring several other occupants.[1]
In January 2019, Tyus' family sued the driver of the vehicle, the department, and Marcum.[1]
The County Attorney's Office, which represented Marcum, argued that Marcum was protected by qualified immunity because his actions were not a substantial factor in causing the crash.[1]
An internal investigation determined that Marcum did not violate the department's policy.[1]
On December 8, 2021, the lawsuit was settled for $600,000.[1]
