2022 Evidence Tampering
The department reopened the investigation into an old homicide case and discovered that evidence was missing.[1]
Response Timeline
During the investigation, it was determined that Birney took evidence from multiple investigations to his personal storage unit.[1]
On May 11, 2023, the Kansas Commission on Peace Officers' Standards and Training (POST) revoked Birney's law enforcement certification for tampering with evidence, failing to cooperate in their investigation, and a lack of good moral character.[1]
