2020 Assault of Rosdward Hernandez

On November 26, 2020, an officer attempted to disperse a crowd of people. Patino arrived as backup and found the officer in a verbal exchange with Hernandez. Hernandez refused commands to move away before Patino pushed him. As Hernandez walked away, Patino confronted him, pushed him into the street, threw him to the ground, and struck him. Another officer intervened.[5]

Hernandez was charged with resisting arrest by physical force, aggravated assault on a police officer, and obstruction.[6]

Response Timeline

The county Prosecutor's Office found a lack of evidence to charge Patino.[6]

On November 25, 2022, Hernandez filed a lawsuit against Patino.[6]

On February 8, 2024, Patino pleaded guilty to misdemeanor counts of deprivation of civil rights for both Alsaidi (see below) and Hernandez. Patino faces up to one year in prison for each count.[5]

Response Timeline

On April 27, 2021, the United States Attorney's Office charged Patino with unreasonable use of force and falsifying a police report.[7][8]

In May 2021, Patino was suspended with pay.[4]

On January 18, 2022, the U.S. Attorney's Office indicted Patino for conspiracy against rights by depriving a person of his constitutional right to be free from use of unreasonable force by law enforcement, deprivation of rights under color of law, and two counts of falsification of records.[9][10]

In November 2022, Alsaidi filed a federal civil rights lawsuit against the officers and the department.[11]

On February 8, 2024, Patino pleaded guilty to misdemeanor counts of deprivation of civil rights for both Alsaidi and Hernandez. Patino faces up to one year in prison for each count.[5]
